dhakal.jpgHari Dhakal, 39, of Worcester, has been charged with several Massachusetts Driving Charges after he allegedly crashed his SUV into a home. He is summonsed to be arraigned in Worcester District Court on charges including Motor Vehicle Homicide and Negligent Operation of a Motor Vehicle.

According to Worcester Police, the occupant of home, Rosemary Turner, was struck when Dhakal’s car allegedly crashed into her house and pinned under the car. Another occupant who was near the doorway was also struck by the impact. She was freed from the crash 45 minutes later and taken to be treated at Umass Medical Center, where she died.

Dhakal reportedly claimed that as he was traveling, his brakes to his Nissan Pathfinder failed. Worcester Police, however, claim that, after physical and mechanical inspection of the vehicle, as well as review of the car’s “black box” with the assistance of the manufacturer, there was no evidence to support that the brakes had failed.

Matthew Murray, 25, of Weymouth, was arraigned in Norfolk Superior Court in Dedham this week on several Massachusetts Drunk Driving Charges stemming from the February 13, 2011, incident that resulted in the death of April Ivil, who was a passenger in his truck. Murrary was has been charged with Motor Vehicle Homicide, Operating Under the Influence of Alcohol, and Negligent Operation of a Motor Vehicle.

According to the Norfolk County District Attorney’s Office, Matthew Murrary was driving his truck on Commercial Street in Weymouth at 5:20 a.m. when he allegedly lost control and hit a snowbank, causing the truck to flip over. One of the two passengers, April Ivil, who was thrown from the truck when it flipped over, succumbed to her injuries.

Weymouth Police Officers who responded to the crash reported that Matthew Murray allegedly smelled of alcohol and allegedly exhibited signs of intoxication. Police also reported discovering several open beer cans in the truck.

Kenneth Brelew, 21, of Somerville, was arrested yesterday morning on Massachusetts Drunk Driving Charges that left three people hospitalized and one woman dead. He is scheduled to be arraigned Monday morning in Somerville District Court on DUI / OUI charges including Operating Under the Influence of Alcohol and Vehicular Homicide.

According to the Massachusetts State Police, Kenneth Brelew and four friends left a party early Friday morning and were traveling on McGrath Highway and Brelew apparently lost control of his car and crashed into a barrier. State Police believe that speed was also a factor.

Four of the passengers in the car, Jerry Altidor and Rudolph Reis, both of Somerville, and Rafaela Pereira, of Everett, were all taken to Massachusetts General Hospital to be treated for minor injuries. Another passenger, however, a 16 year old woman, died at the scene of the crash.

William J. Halpin, III, 25, of Melrose, was arrested on Massachusetts Drunk Driving & Related Charges for allegedly killing a taxi driver and injuring a young child this past Friday in Lynnfield. He is scheduled to be arraigned tomorrow morning in Peabody District Court for Driving Under the Influence of Drugs, 2nd Subsequent Offense, Possession with Intent to Distribute a Class D Controlled Substance, and Vehicular Homicide.

According to the Massachusetts State Police, Halpin was allegedly driving in the Lynnfield area of Route 1 this past Friday when he struck a taxi driver in the breakdown lane. Victor Vargas, 42 of Lynn, was the taxi driver who was parked on the side of the road because his car had been involved in a minor accident with another driver. The other driver and Vargas were standing between the two cars in the breakdown lane when Halpin came and allegedly struck the other car, a Chevrolet Cobalt, then hit Vargas.

Inisde the Cobalt, however, was a 6 year old boy, who suffered serious injuries to his arm and shoulder. The child was transported to Boston’s Children’s Hospital. The driver of the Cobalt, Patricia Ediamen of North Andover, and two other passengers, a woman from Framingham and another child, were not hurt in the crash.

Robert V. Bryant, 50, of Haverhill, was indicted by an Essex County Grand Jury yesterday on various Massachusetts Drunk Driving Charges in connection with a crash this past December just outside the Andover Massachusetts State Police barracks that resulted in the death of Cynthia Anne Ray, of Haverhill.

The Essex County Grand Jury returned criminal indictments against Bryant that charge him with Vehicular Homicide; OUI / DUI Liquor; Negligent Operation of a Motor Vehicle; and Leaving the Scene of an Accident After Causing Death.

According to the Essex County District Attorney’s Office, Bryant allegedly struck Ray with his pickup truck as she left the Andover Massachusetts State Police barracks on Route 125. After allegedly striking Ray, Bryant drove off but was stopped on the highway several hundred yards away.

DUI Arrest.jpgRichard Migliacci, 37, of Somerville, has been indicted by a Middlesex County Grand Jury on Massachusetts Drunk Driving Charges in connection with the motorcycle crash in Somerville this past July that resulted in the death of his passenger, Sinead Lovette, 29, of Braintree.

Migliacci has been charged with Operation of a Motor Vehicle While Under the Influence of Alcohol; Negligent Operation of a Motor Vehicle; Leaving the Scene of An Accident After Causing Death; and Motor Vehicle Homicide.

The Middlesex County District Attorney’s Office alleges that, on July 9, 2010, Migliacci was riding his motorcycle on Route 28 in Somerville at a high rate of speed while he had Sinead Lovett as the rear seat passenger. Traveling at a high rate of speed, he is alleged to have gone through a red light, and while attempting to cut off an oil tanker, striking the median.

Luis Gabriel Escalante, 22, was arraigned yesterday morning in the Chelsea Division of the Boston Municipal Court on Massachusetts Drunk Driving Charges.

Escalante was formally arraigned with Operating Under the Influence of Alcohol, Leaving the Scene of an Accident After Causing Death, and Motor Vehicle Homicide.

According to the Chelsea Police Department, Escalante allegedly struck and killed Julio Vaquerano this past December after driving while intoxicated with alcohol. Vaquerano was found suffering from major injuries in the area of Blossom and Maple Streets in Chelsea, and was pronounced at Massachusetts General Hospital. His injuries were reportedly consistent with being hit by a car.

Jeremy Garnder, 29, was arraigned on Massachusetts Motor Vehicle Homicide Charges and Walter Smith was charged with DUI / Drunk Driving Charges in the car crash that killed Gregory Vilidnitsky, 57, in Framingham last September.

Both men were arraigned in Middlesex Superior Court this past week. Gardner was charged with Motor Vehicle Homicide, Leaving the Scene of an Accident After Causing Death, Leaving the Scene of an Accident Causing Property Damage, and Operating Under the Influence, Second Offense.

Smith was also arraigned on the Drunk Driving Charge of Operating Under the Influence, Fourth Offense.

Robert Bryant, 50, of Haverhill, Massachusetts, was arraigned and charged with Drunk Driving Charges and Motor Vehicle Homicide for striking and killing Cynthia Anne Ray.

According to the Essex County District Attorney’s Office, Ray had gone to the Andover Massachusetts State Police barracks with her mother to file a motor vehicle crash report that involved her husband earlier in the day. As she left the State Police station and headed towards her car, she was struck by a pickup truck. Her mother, not realizing what had happened, ran inside the police station to report that accident. Only when State Police officers responded outside did she discover that it was her daughter that had been struck.

Cynthia Anne Ray was taken to Lawrence General Hospital where she later succumbed to her injuries.

Theary Chan, 26, of Lowell, Massachusetts, was arraigned this morning in Lowell District Court on Drunk Driving Charges in connection with the death of Sgt. Patrick Johnson, an off-duty Lowell Police Officer who was struck and killed early Saturday morning.

Middlesex County Prosecutors allege that Chan was was driving drunk when his vehicle blew a stop sign and struck Johnson, was was riding his motorcycle at the intersection of Princeton Boulevard and Foster Street in Lowell.

Chan was arraigned for DUI / Operating Under the Influence of Alcohol and related Drunk Driving charges and bail was set at $5,000. As a result of the Chan allegedly causing the death of another, he could also be prosecuted for Vehicular Homicide.
